THESE THRILL TERMS OF USE REQUIRE ARBITRATION ON AN INDIVIDUAL BASIS, RATHER THAN JURY TRIALS OR CLASS ACTIONS. PLEASE SEE SECTION 21 (BINDING ARBITRATION AND CLASS ACTION WAIVER) TO LEARN MORE.

THESE THRILL TERMS OF USE APPLY TO BOTH PARTY HOSTS AND PARTY PARTICIPANTS.  SEE PARAGRAPH 6 FOR SPECIFIC RULES THAT APPLY TO EITHER CLASS OF PARTICIPANT WITH THIS APP.

1.      Introduction.

Please read these Terms of Use (“Agreement”) carefully, as these documents constitute legally binding terms and conditions and applies to your use of Services, whether you are accessing the Services via a wireless or mobile device, a tablet a personal computer or any other technology or device (each, a “Device”).  If you are entering into this Agreement in connection with our employment, you hereby represent to THRILL that you are authorized to and hereby do bind your company/employer to this Agreement.  Any references herein to “you” and “your” will refer to both you and your company/employer, as applicable.  This Agreement shall remain in full force and effect while you use the Services and does not cover other services, websites or content made available by any other company or third party, unless specifically stated.  From time to time, we may modify this Agreement.  We recommend that you check back frequently and review this Agreement regularly, so you are aware of the most current rights and obligations that apply to you.  Your use of the Services following the posting or other notification of such changes will signify your agreement to be bound by the changes.

By using the Services you expressly agree to comply with this Agreement and any additional terms and conditions that we provide to you, including in connection with your use of other products and services we may offer or make available to you (“Additional Terms”). The Services may also provide rules of participation for certain activities and services, including contests, sweepstakes, and other initiatives (“Rules”).  The SERVICES PRIVACY POLICY, the Additional Terms and the Rules are hereby incorporated into this Agreement by reference as though fully set forth herein. Any capitalized terms that are not defined in this Agreement shall have the meaning ascribed in the Privacy Policy, Additional Terms and Rules, as applicable.

2.    Services.

Event Attendees. The Services allow registered users that are Event Attendees and/or consumers of THRILL identified events (“Event Attendees”) to access certain features, functionality, information and services provided by us and/or our affiliates, which may include the ability to access personalized information and content regarding certain college campus events or off campus events, speaker functions, identified parties, and other events (“EVENTS & PARTIES”), such as notifications and recommendations regarding those EVENTS & PARTIES and other related products and services.

EVENT & PARTY HOSTS. The Services allow registered users that are Event & Party Hosts (and/or their representatives) (collectively, “Event & Party Hosts”) to access certain features, functionality, information and services provided by us and/or our affiliates, which may include (a) the ability to promote, market, display, message and make certain information and content available to Event Attendees related to the EVENTS & PARTIES and other related products and services, and (b) analysis, statistics, reports and other information regarding your use of this Mobile App, social media interaction and marketing, including the number and location of their “trackers”, number and location of people who have RSVP’d to an EVENT or PARTY, source and volume of ticket clicks and other similar user information (“Manager/Analytics Services”).

Third Party Platforms. Some of the Services (e.g., the THRILL App, etc.) may be dependent on and/or interoperate with third-party owned and/or operated platforms and services (each, a “Third Party Platform”) and may require that you be a registered member of such Third Party Platforms and provide certain account credentials and other information in order to access such Services. Such Third-Party Platforms may provide us with certain additional information about you, which may include your email address, legal name, country of residence, location, date of birth, event descriptions and other preferences and usage data, all as more fully described herein and subject to the terms and conditions hereof, including the PRIVACY POLICY.

3.    Eligibility; Compliance.

Use of the Services is limited to users 18 years of age and older.  By using the Services, you represent and warrant that (a) you are 18 years of age or older and (b) your use of the Services does not violate (i) any applicable law, rule or regulation or University or College or trade school or high school policies or (ii) any applicable terms, conditions, or requirements of any provider of a Third Party Platform. Certain features of the Services may be subject to heightened age and/or other eligibility requirements and restrictions. If you are a user between the ages of 13 and 18, please review this Agreement with your parent or guardian. Your parent or guardian should agree to this Agreement on your behalf and parental discretion is advised for all users under the age of 18 if THRILL agrees to make an age restriction exception at its sole discretion.

4.    User Registration.

You must be eighteen (18) years or older in order to use this App.  If you are not 18, please exit this Terms of Service and any access to the App now.  In order to access and use certain content, features and functionality of the Services, we may require that you (a) register for the applicable Services, whether on our website, a Third Party Platform or otherwise, including, in some instances, creating and/or providing a username and password combination (“User Credentials”) and (b) provide to us and/or make available (e.g., via Third Party Platform permissions and consents, etc.) certain additional information, which may include your email address, legal name, country of residence, location, date of birth, name of organization or company and other preferences, usage data, and for fee-based transactions and purchases offered by us, your physical address, telephone number(s), applicable payment information (e.g., payment card data, i.e. PayPal information, etc.), and other information (collectively, a “User Account”).  Company shall not be responsible for any consequences, damages, actions, lawsuits, injuries – mental or physical that are in any way connected to the use of this Service by minors under the age of 18 with no exception.

You represent and warrant that all registration and account information you submit and/or make available is truthful and accurate and you shall maintain and promptly update the accuracy of such information. Further, if you elect to become a registered user of the Services, you are responsible for maintaining the confidentiality of your User Credentials, and you shall be responsible and liable for any access to or use of the Services by you or any person or entity using your User Credentials, whether or not such access or use has been authorized by you or on your behalf, including any Fee-Based Services (as hereafter defined). You agree to immediately notify THRILL of any unauthorized use of your User Credentials or User Account, or any other breach of security. It is your sole responsibility to (a) control the dissemination and use of your User Credentials and User Account, (b) update, maintain and control access to your User Credentials and User Account, and (c) cancel your User Account on the Services. THRILL shall not be responsible or liable for any loss or damage arising from your failure to comply with this Section 4.

6.    Specific Rules for Party Hosts and Party Participants.

WEAPONS OF ANY KIND ARE STRICTLY PROHIBITED AT ALL PARTIES REGARDLESS OF FEDERAL, STATE, LOCAL LAW OR UNIVERSITY POLICIES.

ILLEGAL DRUGS OF ANY KIND ARE STRICTLY PROHIBITED AT ALL PARTIES REGARDLESS OF FEDERAL, STATE, LOCAL LAW OR UNIVERSITY POLICIES.  PERSONS WHO ARE NOT OF LEGAL AGE PER STATE AND OR UNIVERSITY POLICY SHALL NOT CONSUME ALCOHOL AT ANY PARTY.

NO VIOLENCE OF ANY NATURE IS ALLOWED AT ANY PARTY.

ALL PARTY HOSTS AND PARTY PARTICIPANTS SHALL NOT ENTER ANY PARTY PREMISES WITHOUT BEING VACCINATED FOR COVID 19 AND PROVIDE PROOF OF VACCINATION TO THE ENTRANCE SECURITY OF THE PARTY AND SHALL WEAR MASKS FOR THE PROTECTION OF THEMSELVES AND OTHERS UNLESS RECOMMENDATIONS BY THE CENTER FOR DISEASE CONTROL (“CDC”) PROVIDE ALTERNATE RECOMMENDATIONS IN WHICH CASE PARTY HOSTS ARE RESPONSIBLE TO INSURE SAID CDC REQUIREMENTS ARE STRICTLY ADHERED TO.  THE ALTERNATIVE TO PROOF OF VACCINATION IS TO PROVIDE PROOF OF A NEGATIVE COVID TEST THAT IS NO MORE THAN 48 HOURS OLD.
